We are responsible for permitting and inspecting all Part A2 and Part B prescribed processes. These businesses have the potential to cause air pollution and include numerous activities including among others vehicle re-spraying, dry cleaning and petrol stations.
Any person operating an installation that requires a permit must submit an application form with a fee to the local authority. The operator of the prescribed process must comply with the conditions of the permit and they will be subject to inspection to ensure this is the case.
Legislation
Prescribed processes are those industrial technologies that have the potential to cause pollution. The Environmental Protection Act 1990 required that processes identified in the act or by regulations made under the act, must have an authorization to operate.
Following the introduction of the Pollution Prevention and Control Act 1999, the system of authorisation changed to meet the requirements of the European Directive on Integrated Pollution Prevention and Control (IPPC).
The new act covers a wider range of industrial processes than the Environmental Protection Act 1990, using A1, A2 and B classifications, with the Environment agency controlling Part A1 processes and local authorities controlling those classified as A2 and B.
The Pollution Prevention and Control (England and Wales) Regulations 2000 (PPC Regulations) have recently come into force under the Pollution Prevention and Control Act 1999 (PPC Act). These require polluting industries to be permitted rather than authorised.
Application
Our role is to write a permit that contains a number of conditions the purpose of which is to control the way in which the process operates and set emission standards or pollution levels. We inspect these processes routinely and more often where we suspect problems may be happening. Breaching the conditions we set will lead to enforcement action and can lead to prosecution.
Installations covered under Part A of the regulations require controls to ensure the protection of the environment from emissions to air, land and water (including discharges to sewer) and any other activities which may have an environmental impact. The Environment Agency is responsible for controlling A1 installations, local authorities for A2 and B installations.
