A building company has been prosecuted for completely blocking the pavement with building materials, during development of a site in Homestead Road, Chelsfield. Lyndhurst Building Services of Dalton Road, Chelsfield, pleaded guilty to the offence and were ordered to pay fines and costs of £800 by Bromley Magistrates Court.

“We want companies to work in partnership with us. If they had applied for a temporary highway licence to legally place their materials on the road or pavement, we would have been able advise them on how to provide a safe, temporary footway. Any pavement obstruction is potentially dangerous but more so if it causes pedestrians to walk out into the road” said Councillor George Taylor, Executive Councillor for the Environment.

During the hearing, the Court was informed that one of the Council’s Street Services Enforcement Officers had inspected Homestead Road in June of this year. The pavement next to a development site was found to be totally inaccessible to pedestrians - due to Lyndhurst Building Services materials and fencing causing an obstruction. Although the site manager was asked to remove the items blocking the pavement, an inspection the following day revealed that the pavement remained impassable. After promising to clear the footway over the weekend, another inspection was made on Monday morning. With no sign of any attempt having been made to clear the footway, legal action was taken.
