Paving the way for a fine
A company has been prosecuted for obstructing the footway with paving blocks during construction of a driveway in Hayfield Road, Orpington. The Swanley company pleaded guilty to the offence at Bromley Magistrates’ Court last month and was ordered to pay fines and costs totalling £700.
“We prefer not to have materials stored on the road or pavement but where it is absolutely necessary, we operate a licensing scheme. We will only agree to issue a licence once we have checked the location and ensured the safety of the travelling public” said Peter Turvey, Street Services Enforcement Manager.
The Court heard that a Council enforcement officer had already warned the company that they needed to apply for a highway licence to legally store their stack of paving blocks on the footway. When a subsequent inspection revealed that the materials, measuring around 3ft by 2ft by 4ft high, were still being stored on the pavement without a licence, legal action followed.
Anyone who wants to place a skip, materials, scaffolding, hoarding or any other temporary item on or over any part of the road, will need to apply for a temporary highway licence. A licence will only be granted once the location has been inspected and approved by an enforcement officer.
