The Education Welfare Service has a statutory duty to investigate where it appears that a young person is not attending school regularly. On completion of investigation, the following legal interventions will be considered if it is deemed an offence has been committed:

  • Education Supervision Order
  • Penalty Notice
  • Summons Section 444(1) / 444(1a) Education Act 1996
  • School Attendance Order

Schools and agencies (for example the Police) can apply for the issue of a penalty notice to parents of pupils who are found in a public place during the school day whilst excluded.
