Risk description
When tested in accordance with 8.3 (torque test) the blue 'collar' unscrewed from the shaft of the pen before reaching the specified minimum of 34 cNm. The detached collar and nib component fitted wholly inside the small parts cylinder, and therefore poses a serious risk of choking to a child under 36 months. The product's flexible plastic bag used for packaging also has an area greater than 100 mm x 100 mm and the bag thickness measured as 0.034 plus / minus 0.002 mm which is less than the minimum permissible limit of 0.038 mm. The bag therefore poses a potential asphyxiation hazard. This product does not meet the requirements of the Toys (Safety) Regulations 2011.
