Requests for CCTV images

Primary requests to view CCTV images are likely to be made under the Schedule 2 of Data Protection Act 2018 by third parties for any one or more of the following purposes:

  • Providing evidence in criminal proceedings (Schedule 2 Part 1 5(3))
  • Providing evidence in civil proceedings or tribunals (Schedule 2 Part 1 5(3))
  • Prevention of crime (Schedule 2 Part 1 2(1))
  • Investigation and detection of crime (may include identification of offenders) (Schedule 2 Part 1 2(1))
  • Identification of witnesses. (Schedule 2 Part 1 2(1))

Third parties must show adequate grounds for disclosure of data within the above criteria. Third parties may include, but are not limited to:

  • Police,
  • Statutory investigation agencies (e.g. HMRC, Department of Work and Pensions, Environment Agency, Health and Safety Executive, Trading Standards),
  • Solicitors and other officers of the court,
  • Claimants in civil proceedings,
  • Accused persons or defendants in criminal proceedings, and
  • Other agencies with a genuine purpose.

On receipt of a genuine request for the release of data, the Council will ensure the retention of data which may be relevant to the request. An appropriate time limit shall be imposed on this retention and the requestor will be notified of this without undue delay.

All such enquiries will be treated with strict confidentiality.

Road traffic collisions and other civil matters

If you have been involved in a road traffic collision or your vehicle has been damaged in a car park or on the highway or in any other civil matter, you should contact your insurance company or your solicitor and ask them to request CCTV images from LB Bromley CCTV service.

If you are an insurer or other agent requesting CCTV images on behalf of your client, you will be required to provide a letter on letter-headed paper confirming your client’s details, the basis for which you are seeking this information and confirmation that you are authorised to make this request on your client’s behalf. Further details may be sought by the London Borough of Bromley, if required.

To search for CCTV images of such an incident, we charge £275. If relevant CCTV images are found, they will be released free of charge.

Individual subject access under data protection legislation

You have a right to obtain a copy of CCTV footage that shows you. This is called a Subject Access Request (SAR).

If you have been a victim of a crime, then you must report the incident to the Police who will give you a crime reference number. All criminal matters are to be dealt with by the Police and we will release the CCTV evidence to them.

For CCTV subject access requests, we will usually only provide recorded images that show the person making the request unless all other individuals who may be identified from the same information have consented to the disclosure or it is appropriate in all the circumstances to release the images without their consent.

All other personal data that may allow the identification of any other person should be concealed or erased and third-party data will only be released without third party consent where the council considers it appropriate to do so.

We will not be able to provide recorded images if insufficient or inaccurate information is provided and we are unable to identify the images.  Where it is not appropriate to release third-party data, we will see if images can be concealed or redacted or erased to allow a disclosure.  If that is not possible, we will make reasonable efforts by, for example, providing a description of the CCTV images and of what is shown. Each request is to be treated on its own merit.

No charge will be made for CCTV images released under a SAR.

What happens next

CCTV enquiries will normally be responded to and completed within 5 working days unless further processing of the images or enquiries are required (e.g. if images are to be redacted or to obtain third party consent).

If recorded images of the incident are available and meet all of the conditions set out above, the council will release the images.

Please be aware that CCTV images are held for a maximum of 30 days, after which they are destroyed. If the incident you wish to enquire about occurred more than 30 days ago, please do not submit an enquiry as the images will have already been destroyed.
