A business has been prosecuted for failing to demonstrate their legal duty-of-care, which follows an investigation about an increase in dumped rubbish near to the retail premises in Bromley.

The prosecution and investigation, which was part of the council’s ongoing work to tackle fly-tipping, has prompted a warning to businesses that they need to be able to demonstrate how they dispose of their waste as part of their legal duty of care.

The director of Phone Gadget Limited, Mr Muhammad Waseem Khan Raja located at 149 Bromley High Street, pleaded guilty to failing to demonstrate his duty of care under the Environmental Protection Act 1990. Mr Raja was ordered to pay a total of £1,420 in fines and costs.

Councillor Page, Executive Councillor for Public Protection and Enforcement said, “Businesses must take responsibility for how they dispose of their waste and be able to demonstrate how they are disposing of their waste. Failing to respond to the council’s enquiries only undermines our efforts to keep Bromley’s streets clean, with prosecution a last resort, which followed the non-payment of the Fixed Penalty Notice. If businesses need help and advice about their waste, we would encourage them to get in touch, with information on our website, with all of this helping to keep our streets clean as well as avoiding unnecessary prosecution.”

On 8 January 2025, a Section 34 notice was issued to Phone Gadget Limited, located at 149 Bromley High Street. The notice required the company’s director, Mr Muhammad Waseem Khan Raja, to provide documentation demonstrating how the business disposes of its waste and meets their legal duty of care.

Despite multiple follow-up letters and a £300 Fixed Penalty Notice issued to Phone Gadget Limited, no documentation or payment was received. A final warning letter was sent in March, with prosecution then following.

Residents and businesses are encouraged to report fly-tipping via the council website. Fly-tip incidents are routinely investigated with a view to prosecute those responsible.
