Fly-tipping incidents captured on CCTV have resulted in two prosecutions, underlining the council’s ongoing commitment to tackle fly-tipping.

Both incidents involved sacks of refuse being illegally dumped either beside or on top of the recycling banks located in Chislehurst and Green St Green. In both incidents, no attempt was made to use the recycling banks, even if what was being left could be recycled. The prosecutions have prompted a warning to others not to leave any waste around the recycling banks nor misuse the recycling facilities, which can be dangerous, is unsightly and deters others from recycling. Offenders are being warned that they potentially face prosecutions.

In the first incident, on 28 September 2025, Mr Paul Misfud of Bishops Butt Close, Orpington was identified after CCTV footage showed refuse sacks being deposited on the ground beside the recycling banks in Pinewood Drive. After an investigation, Mr Misfud was issued a Fixed Penalty Notice. In a separate incident on 17 November 2025, Mr Mark Brown of Westwood Park, Forest Hill, was also identified after dumping multiple full refuse sacks on and beside the recycling banks in High Street Chislehurst car park and also issued a Fixed Penalty Notice.

Both investigations relied on high‑quality CCTV evidence and when the Fixed Penalty Notices were not paid, prosecution followed. Mr Misfud and Mr Brown were subsequently prosecuted on 21 April 2026, with both pleading guilty to illegally depositing waste under Section 33 of the Environmental Protection Act 1990. Mr Misfud was ordered to pay £510 in fines and costs, and Mr Brown was ordered to pay £400 total in fines and costs.

A council spokesperson said, “We will continue to tackle fly‑tipping in all its forms, wherever it happens, even when left at a recycling bank. Dumping refuse sacks at a recycling bank actually makes it harder for others to use the recycling banks properly. Our recycling banks are regularly emptied and whilst no attempt was made in these prosecutions to check to see if the bins were full, even if they are full, the advice is to take your recycling home or to another recycling bank.”

Residents are also being reminded that waste must only be given to a licensed waste carrier and that checks should always be made to ensure waste is disposed of responsibly. Residents can check that the person or business they are using to dispose of waste is a legally registered waste carrier. Fly‑tipping can be reported online at: www.bromley.gov.uk/report.

Residents can also dispose of bulky items of waste at the Weekend Reuse and Recycling Centre on Baths Road or by booking an appointment for the council to collect items direct with details on the council’s website.
