A man who persisted in drinking in a prohibited area has been prosecuted after refusing to comply with a Public Space Protection Order (PSPO).

The prosecution follows an incident on 20 October 2025 where the individual was seen consuming alcohol on High Street, Orpington, an area covered by a PSPO which prohibits public drinking. This order forms part of the council’s continued long-term efforts to tackle anti-social behaviour related to alcohol consumption.

A Neighbourhood Enforcement Officer on patrol approached the man and requested that he stop drinking and dispose of the alcohol. Body-worn camera footage captured the defendant refusing to comply with this direction, and a £100 Fixed Penalty Notice was issued as a result. When the Fixed Penalty Notice remained unpaid, despite reminder letters being sent, prosecution followed.

On 28 May 2026, David Green of College Road, Bromley was convicted under Sections 63(6) and 68 of the Anti-Social Behaviour, Crime and Policing Act 2014. Mr Green was ordered to pay a fine and costs, including a surcharge, totalling £240.

Councillor Angela Page, Executive Councillor for Public Protection and Enforcement said: “We want residents and visitors to be able to enjoy our borough safely and respectfully, without the potential fear of being harassed by those intoxicated by alcohol. Public Space Protection Orders are in place to prevent the anti-social behaviour that often arises from drinking in the street, with prosecutions extremely rare and a last resort. Where individuals refuse to comply with directions when asked and where the evidence exists, the council will not hesitate to take further action.”

Residents are reminded that Public Space Protection Orders are in place to help prevent anti-social behaviour and protect public spaces. The borough’s PSPOs include restrictions on alcohol consumption in public spaces across the borough, giving authorised officers the power to require individuals to stop drinking and surrender alcohol. Failure to comply with these requirements may result in enforcement action, including Fixed Penalty Notices and, where necessary, prosecution.
