Biggin Hill Airport Ltd - application to alter the lease

Biggin Hill Airport has requested an alteration to the Permitted User clause in its lease. This request was reported to the Executive, which is the decision-making body in this instance.

The initial request is outlined fully and transparently in Part 1 of the committee report which is available to the public. The council has sought legal advice, which is outlined in Part 2 of the report. This is being kept confidential as disclosure could compromise the council’s position.

The following information is designed to help residents understand the request and the procedure in addressing it:

What request has been made by Biggin Hill Airport Ltd?

Biggin Hill Airport Ltd would like to change the definition of the Permitted User in clause 1.8 of its lease with London Borough of Bromley. The extent of the requested change can be seen in the report to the Executive.

The council and the airport are in a landlord and tenant relationship. As such, a tenant can contact its landlord at any time asking for changes to their lease. As the landlord of the airport, it is the council’s legal obligation to consider this application and there is a clear, set process to this, with  the Resources and Contracts Policy Development and Scrutiny Committee considering this prior to the Executive’s decision.

How could residents attend the meeting?

Bromley residents were able to attend the Executive meeting, which was held at the Civic Centre, though numbers were limited to ensure the meeting took place in a Covid-safe environment. The meeting was also live streamed on the council’s website to ensure residents who could not attend in person could still follow the meeting. The meeting can still be viewed.
