Terms and conditions

Promotional activities are a valued part of Bromley Town Centre community that includes market traders, shops, businesses, buskers, residents and members of the public.

However we also note that any promotional activity must be carefully managed to ensure that they do not unduly inconvenience other users of the Town Centre. Bromley Council’s promotional activities terms and condition aim to find a balance between these conflicting issues in order to ensure that an amenable climate exists within the town centre. 

Bookings

Bookings can only be confirmed up to three months in advance; we do not confirm booking requests beyond that in order to prevent block booking by any one organisation and also to ensure minimal clashes with other Town Centre activities (such as seasonal events and specialist markets)..

Bromley Council will seek to ensure a balance between different activities on the High Street, so not all promotional areas may be hired out at any one time. 

Space

  • The granting of an application permits the applicant to conduct their promotional activity within the designated space. All activities should reflect the designated promotional space areas and not extend beyond them.
  • All people taking part in a promotional activity must not ‘roam’ up and down the High Street and may not switch to another promotional space that they do not have permission to operate from. 
  • All promotional activities must ensure that there is a minimum 4m fire path around all sides of their designated space to enable emergency vehicle access up and down the High Street.

Activities 

  • All promotional activities shall be licenced between the hours of 9am and 5pm on their respective days. However people involved in the activity are permitted to enter the High Street for set up between 7am and 8:30am, and again after 5pm for set down, however no promotional activity must take place during these hours. 
  • As part of your promotional activity you may either sign customers up to a service or hand out gifts however you must not take any form of payment for this and people must not feel obliged to pay. If you wish to take a deposit or to trade any physical items as part of your promotion you will also require a separate Street Trading Licence in addition to your promotional booking application. If you require this you can inform the council on the online booking form, and we will co-ordinate it for you. However please note that this will incur an additional Street Trading fee. 
  • Registered Charities may collect donations as part of their promotional activities but will first need to achieve permission from the Metropolitan Police via a charity collection licence 
  • Promotional activities may only hand out food samples that are pre-prepared and sealed, and the content of these must be explicitly outlined on your application. Food preparation on site is not permitted without explicit permission from Bromley Council. To obtain this you will be required to register as a food business where you will be required to provide your food business registration details and a hygiene rating. 
  •  Promotional activities may not feature music, entertainment acts or any type of amplification unless explicitly permitted by Bromley Council. If you intend to utilise any such activities they must be clearly outlined on your application so that they can be approved by a Council Operative. 
  • Bromley Council aims to present an inclusive and pleasant shopping experience for all High Street users thus we ask that promotional activities remain considerate at all times. Any behaviour or marketing strategy that we deem to be overly assertive or aggressive may result in the activity being asked to cease earlier than planned and the offender will not be asked to return. 
  • Promotional activities must not consist of any form of material that Bromley Council considers offensive (including on the products and literature associated with the activity). This will include (but not be limited to) any material that Bromley Council judges that is:

-    Racist
-    Sexually Offensive/Pornographic
-    Homophobic
-    Depicting any sexual or violent acts
-    Defamatory
-    Inflammatory (containing extreme religious or political views)
-    Would cause humiliation to any other town centre users. 


Generators

  • Promotional activities and displays will not generally have access to electricity or water facilities. However, you may use your own independent generators with the permission from Bromley Council however you must clearly outline on your application the type and size of generator that you wish to use. 
  • If you are authorised to use a generator this must remain within the promotional area and must be clearly signposted to other town centre users to avoid trip hazards. Wires must not be allowed to trail extensively over the town centre. 

Vehicles

  • If you require a vehicle to transport materials for setup of your activity, a permit allowing access to the pedestrianised part of the High Street via the retractable bollard at the junction with Elmfield Road will be provided as part of the promotional booking. You will be responsible for following all the terms and conditions of this permit as part of your licence, in particular that you only try to enter before 9am and after 5pm.   • If a vehicle is required as part of the promotional display itself the vehicle must be stationary between 9am and 5pm in the agreed promotional area and must not move at any time unless specifically instructed by the emergency services or the market supervisor. 

Waste

  • All people involved in the promotional activity will be responsible for ensuring that both the assigned and the surrounding area remain clean and tidy throughout the day.
  • Any waste generated as part of the promotional activity must be taken away with you at the end of the day. 
  • Anybody involved in a promotional activity must not dispose of any liquid or substance that may disrupt the free flow of a sewage system down the drains or onto the pavement, road or grassland. Council officers will take all steps they consider appropriate if promotional activities are found to be disposing of liquid in an irresponsible manner. 

Advertising

Bromley Council do not licence advertising boards as part of a promotional activity or for the purposes of attracting attention to the said activity in an alternative location. 

Complaints/breaches of terms and conditions 

  • Where a complaint is received, the council will firstly ask that the person tries to resolve the issue themselves by talking to the complainant. When doing so, we ask that both the complainant and those involved in the promotional activity remain respectful and considerate to one another, and that they both try to understand each other’s point of view. 
  • Where issues cannot be resolved Bromley Council may then intervene and seek to resolve it. If this is still unsuccessful, as a last resort the council will take enforcement action. 
  • Where enforcement action has been taken and promotional space users are informed that they are failing to abide by the terms and conditions we expect that their organisations will take action to ensure compliance when informed of any breach by Bromley Council. 
  • If an organisation continues to breach terms and conditions following notification of an issue by Bromley Council it will result in that organisation being excluded from any future and continuing with any confirmed bookings. No refunds would be given in such circumstances.
